In the Government Orders 3rd and 4th read above, orders have been issued fixing the fee for the B.Tech., B.Arch. and other Engineering Programmes offered by the Private Un-Aided Professional Higher Education Institutions (Engineering Colleges) in the State of Andhra Pradesh for the block period 2020-23. Since the new fee has to be fixed for the block period 2023-26, the A.P. Higher Education Regulatory and Monitoring Commission (APHERMC) has issued a notification No.01/ADMN/APHERMC/2022 dated 30-06-2022, requesting the Managements of all the Private Un-aided professional Higher Educational Institutions in the State of Andhra Pradesh to submit relevant data, together with-their audited financial statements for the year 2020-21 and 2021-22 in the prescribed schedules.


 Aggrieved with this notification, the Andhra Pradesh Private Engineering Colleges Managements Association & another have filed Writ Petition Nos.30909, 32967 and 35109 of 2022 before the Hon'ble High Court of Andhra Pradesh seeking direction for the 2nd respondent (APHERMC) to rely on audited financial statements of each institution for fee proposals instead of the extensive data prescribed in 31 Hon'ble High Court of Andhra Pradesh in its Interim orders dated:12.10.2022 in W.P.No.32909, 32967 and 35109 of 2022: "... the process should go on pursuant to the impugned notification dated 30­06-2022 and in so far as furnishing of all the details by the petitioners are concerned under the schedules like Statement of Legal Expenditure, Statement of Gardening Expenditure, Statement of on Seminars, Workshops, Student Related Expenditure, Fests, Statement of Institutional and Quality Parameters, Independent Balance Sheet of the Society/Trust, and the details of Tax Deductions at Source as per I. Act they shall not be insisted by the 2nd respondent at this stage from the petitioners and in so far as the rest of the details are concerned the same can be furnished by the petitioners and any regulation of fee is subject to outcome of this Writ Petition".


In compliance of the Interim orders of the Hon'ble APHC, the Member Secretary, A.P. Higher Education Regulatory and Monitoring Commission (APHERMC), Tadepalli vide reference 7th read above has furnished the minutes of the 86th Meeting of the Commission held on 16.06.2023 along with the recommendations regarding fee structure for B.Tech., B.Arch., and M.Tech Engineering Programmes offered by the Private Un-Aided Professional Higher Education Institutions (Engineering Colleges) in the State of Andhra Pradesh for the block period 2023-26, and requested the Government to issue necessary orders under Section 7 of Andhra Pradesh Education Institutions (Regulation of Admissions and Prohibition of Capitation Fee) Act. 1983 for execution of fee structure.


After examination of the above proposal of APHERMC, the Govt., vide letter 18.07.2023 (reference 8th read above) has requested the Commission to review the fee proposal for B.Tech, B.Arch and M.Tech programmes duly considering certain parameters mentioned therein. The Member Secretary, APHERMC, vide letter dt.19.07.2023 (reference 9th read above) has furnished the extract of minutes of the 92nd meeting of the Commission held on 19.07.2023, wherein the Commission reviewed and recommends a minimum fee of Rs. 40,000/- for the block period 2023-26 at UG level for such category of colleges, and the same minimum fee will be fixed for new programmes or the courses run by new colleges during the whole ensuing Block Period 2023-26.


While the matter is under examination by the Government, the Hon'ble High Court of Andhra Pradesh in its interim orders dt.02.08.2023 vide reference 10th read above, has passed the following interim orders: "...this Court deems it appropriate to enhance the existing fee of the academic year 2022-2023 at the rate of 10% for the present academic year 2023-2024, but as far as minimum fee is concerned it should be enhanced more than 10% and finally it is agreed at Rs.43,000/- by all the stake holders. For the reasons stated above, the respondents are directed to notify and publish minimum fee at Rs.43,000/- and in respect of other colleges whose existing fee for the year 2022-2023 is more than minimum fees, its fees should be enhanced from the existing fee of the academic year 2022-2023 at the rate of 10% for the present academic year 2023- 2024, as a tentative measure till the finalization of the fee by the Respondent Commission and subject to result of the writ petition."


In compliance with the above directions, orders were issued vide Government orders 11th to 18th read above, for the fixation of fee structure for one year for B.Tech, B.Arch, and other Engineering programmes offered by the Private Un-Aided Professional Higher Educational Institutions (Engineering Colleges) in the State of Andhra Pradesh for the Academic Year 2023-24, subject to result of Hon'ble APHC orders in the said writ petitions. Accordingly, the admissions have been conducted for AY 2023-24 with the said fee structure.


As the matter stood thus, the Hon'ble High Court in its final orders dated 05.12.2023 has ordered as follows (operative portion):The worksheets should be furnished to the institutions who requested them and who provided relevant data for determining the fees during the slab period of 2023-2026.

  1. Slabs' particular limit cannot be fixed for any expenditure category submitted by the institution; rather, they should be assessed based on solely on the relevant data as provided by the institution.
  2. Notifying the Tuition Fee, inclusive of numerous heads (in contradiction to the definition of 'Fee' in accordance with the Act and Rules), is deemed illegal and arbitrary. Additionally, the Fee must be formally notified in adherence to the Act and Rules.
  3. While fixing the fee, the Commission should address the claims of the petitioners taking into consideration the rate of inflation, increased expenditure, actual average intake instead of sanctioned strength, accreditations, further improvements towards amenities and research-oriented facilities, especially for professional institutions."
  4. The Government have preferred Writ Appeal No.197/2024 against the orders of the APHC orders dt:05.12.2023 in W.P.No.32909/2022. Further, the APHERMC has also preferred 5 appeals in the matter vide WA Nos 118, 182, 183, 187 and 191 of 2024 on the orders of Hon'ble APHC. All these Writ Appeals are clubbed together and are listed for the next hearing.
After examining the matter in consultation with advisory Departments, Government vide reference 21' read above, have requested the Member Secretary, APHERMC to to take speedy steps to fix the fee for B.Tech., B.Arch., and other Engineering programs for academic year 2024-25, in compliance with the final orders dt:05.12.2023 of the Hon'ble High Court in W.P. No.32909/2023 & batch, subject to outcome of writ appeals pending before the court in the matter, and furnish the proposal for fee fixation to the Government in order to notify the same.

    The Member Secretary vide reference 22nd read above, has informed that the Commission discussed in its 103rd Meeting and the considered opinion of the Commission is that the matter is `sub-judice'. The Commission is also of the considered view that since the recommendations relating to the fixation of fee for B.Tech.,M.Tech., B.Arch. and M.Arch., Programmes, of the Commission furnished on 16.06.2023 and revised on 19.07.2023 are pending with the Government, and it is desirable that the fee recommended by the Commission be notified by the Government for the block period 2023-26, subject to the result in the Writ Appeals.

      The learned Advocate General vide reference 23rd read above, has informed that the Writ Appeals filed by APHERMC & Government came up before the Hon'ble Division Bench on 03.7.2024 and was part-heard. During the course of hearing, the Senior Counsel appearing on behalf of the APHERMC informed to the Hon'ble Court that a proposal with regard to fixing of fee for B.Tech, M.Tech, B.Arch., and M.Arch., programmes are pending before the Government. In this regard, the Hon'ble Court directed to ascertain the status on the proposal sent by the Commission and if the proposal is pending, the Hon'ble Court further directed the State to dispose of the proposal expeditiously. The learned Advocate General requested to take note of the directions of the Hon'ble Court passed in the above batch of cases and take necessary action in this regard.

        After examining the entire issue, Government have decided that fees proposed by the APHERMC for the block period 2023-26 in its 92nd Meeting on 19.07.2023 be notified for the AY 2024-25, subject to outcome of Writ Appeals pending before the Hon'ble High Court.
        Accordingly, Government hereby issues the following Notification which shall be published in the Andhra Pradesh Extra-Ordinary Gazette:

          NOTIFICATION


          In exercise of the powers conferred under Section 7 of Andhra Pradesh Educational Institutions (Regulation of Admissions and Prohibition of Capitation Fee) Act, 1983 (Act No.5 of 1983), the Government hereby notify the fee as mentioned in the Annexures I, II appended to this Order for fixation of fee structure for B.Tech., B.Arch., Programmes respectively, offered by the Private Un-Aided Professional Higher Education Institutions (Engineering Colleges) in the state of Andhra Pradesh for Block Period 2023-26, subject to outcome of Writ Appeals pending before the Hon'ble High Court and subject to following directions:


          The fee is an all-inclusive annual fee, including like tuition fee, affiliation fee, cost of identity card, medical fee, inter college/inter university sports, games & cultural meet fee, computer/internet fee, College magazine and student activities, student health care scheme, student welfare fund, study tour, alumni fund, sports and games fee, examination fee including stationery, maintenance and amenities fee, extracurricular activities fee, development fee, Recognition fee, Common Services fee and other recurring expenditure;

          1. The aforesaid fee determined for the Engineering programmes for the colleges mentioned in Annexure-I (B.Tech), Annexure-II (B.Arch) Programmes, does not include hostel, transport, mess charges, registration fee, admission fee and refundable deposits of library and laboratory fee.
          2. The fee fixed is a tentative measure till the finalization of the fee by the Commission and subject to result of the Writ Appeals pending before the APHC.
          3. The institutions whose affiliations are not extended by the affiliating Universities for the Academic Year (AY) 2024-25 are not entitled to collect any fee till the affiliation process is completed.
          4. In the case of a new college/course, the fee structure shall be the least of the fee regulated for the institutions in the same programme or course for the AY 2024-25.
          5. The institution shall not charge either directly or indirectly any other amount over and above the fee fixed in Annexure-I (B. Tech), Annexure-II (B. Arch) Programmes or which may be modified based on the court directions in future, for 4 years for the students admitted during the AY 2024-25. If any other amount is charged under any other head or guise i.e., donations, etc. the same would amount to charging of capitation fee and in that case the institution shall be liable to be prosecuted under Section 9 of Andhra Pradesh Educational Institutions (Regulation of Admissions and Prohibition of Capitation Fee) Act, 1983 (Act No.5 of 1983) apart from imposing appropriate penalty under the APHERMC Act, 2019 and the APHERMC Rules, 2019 as amended subsequently from time to time;
          6. The institutions are cautioned to maintain proper accounts following lawful practices (Accrual/Mercantile basis of Accounting) including processing payments and receipts through Banks and follow the Regulations as well as guidelines of the Commission in submitting data for evaluation and regulation of fee proposals henceforth. In default their respective fee proposals are liable to be rejected under Regulation 5 (B)(viii) of APHERMC Regulations and such instances shall not be forwarded to the Government for fixation of fee;
          7. In case of any deviation from these directions, the Commission will initiate serious penal action as per the provisions of the Act and Rules made there under;
          8. Under Section 12 (4) & (5) of A.P. Higher Education Regulatory and Monitoring Commission Act, 2019, the Commission has the power to review and determine the fee payable to the Higher Educational Institutions and review the fee determined, whether notified or not by the Government for any academic years/block periods;

          The institutions are informed that the fixation of Fee structure by the Government will not by itself enable or permit the managements to run programmes, if the programmes are not recognized/permitted by the Government/All India Council for Technical Education/PCl/UGC/NCTE and concerned University/any other statutory Authority.
