In the reference 15t read above, orders were issued enhancing the age of superannuation of Government employees from 60 years to 62 years w.e.f. 01.01.2022 as per the Andhra Pradesh Public Employment (Regulation of Age of Superannuation) (Amendment) Ordinance, 2022, which was later on enacted as Andhra Pradesh Public Employment (Regulation of Age of Superannuation) (Amendment) Act, 2022 (Act No.4 of 2022).
In the reference 2nd read above, the Registrar, Sri Padmavati Mahila Visvavidyalayam (SPMVV), Tirupati has informed that the G.O.Ms.No.15, Finance (HR.IV-FR&LR) Department, dated.31.01.2022 has been placed as an Agenda item in the Executive Council meeting held on 28.03.2022 with regard to the age of superannuation of Sri Padmavati Mahila Visvavidyalayam Non-Teaching employees to be amended from 60 years to 62 years with effect from 01.01.2022 on wards and accordingly requested the Government to issue clarification to the University.
When the matter is under examination in the Government, certain non-teaching staff of various Universities, who attained/going to attain the age of superannuation of 60 years have approached the Hon'ble High Court of A.P, obtained interim orders to continue them in service till attaining the age of 62 years, on par with the Government employees already covered under G.O.Ms.No.15, Finance (HR.IV-FR&LR) Department, dated.31.01.2022. Against this, Writ Appeals have been filed by the Universities and the Further, the Hon'ble A.P High Court after allowing the Writ Appeals, stayed the interim orders passed by Single Judge in various Writ Petitions, duly ignoring the contentions of the petitioners of WPs.
The Secretary, A.P. State Council of Higher Education (APSCHE), vide his letters 3rd and 4th read above has stated that the Universities have requested for enhancement of age of superannuation from 60 to 62 years to non-teaching staff by duly passing resolutions in their respective Executive He has also submitted the details on enhancement of age of superannuation from 60 to 62 years to non-teaching staff working in other Universities, which are under the administrative control of various Departments of Secretariat. Further, the Government have obtained certain details from Dr.YSR University of Health Sciences, Acharya N.G.Ranga Agricultural University, Dr.YSR University of Horticulture University, Sri Venkateswara Veterinary University, Andhra Pradesh Fisheries University, Damodaram Sanjivayya National Law University and Sri Venkateswara Vedic University, through their concerned department of Secretariat.
After careful examination of the matter, Government hereby permit all the Universities in the State of Andhra Pradesh (i.e., the Universities under the control of various departments viz., Higher Education, HM&FW, Agrl.& Coop, Animal Husbandry, Law and Revenue) including the Universities of Higher Education Department listed under X Schedule of A.P Re-organization Act, 2014, for enhancement of superannuation age from 60 years to 62 years to the regular non-teaching staff with prospective effect only i.e., from the date of issue of this order. Necessary budget support will be provided by the Government in this regard.
The Departments of the A.P. Secretariat, mentioned in Para 5 above, shall take further necessary action in the matter in respect of the Universities under their administrative control and ensure that the concerned Universities shall resolve to adopt these orders.
This order issues with the concurrence of Finance Department vide U.O.No.FIN01-HR/92/2022-HR-IV, Computer No:1717548, dt.13.02.2024.
