AMENDMENT OF SUB-RULE (17) OF RULE 10 OF THE ANDHRA PRADESH EDUCATIONAL INSTITUTIONS (ESTABLISHMENT, RECOGNITION, ADMINISTRATION AND CONTROL OF SCHOOLS UNDER PRIVATE MANAGEMENTS) RULES, 1993 ISSUED IN G.O.Ms.No.1, EDUCATION (PS.2) DEPARTMENT, DATE: 01.01.1994.

NOTIFICATION:
In exercise of the powers conferred under section 99 of the Andhra Pradesh Education Act, 1982 (Act.No.1 of 1982), the Government hereby make the following amendment to the Andhra Pradesh Educational Institutions (Establishment, Recognition, Administration and Control of Schools under Private Managements) Rules, 1993 issued in G.O.Ms.No.1, Education (PS.2) Department, dated 01.01.1994 as subsequently amended from time to time:
AMENDMENT:
In the said Rules, in Rule 10, for sub-rule (17), the following shall be substituted, namely,
"(17) That when a private aided school is forced to be closed down for any reason or whenever the management of the school goes out of the way to remove any of its staff members or whenever there is fall in strength in a private aided school for two successive academic years or whenever an exercise for rationalization of aided staff working in aided institutions is taken up, the competent authority may transfer the aided staff, with or without post, as the case may be to any other needy Private aided school within the district. Still, if there are any surplus aided staff, the competent authority may transfer the aided staff without post to any other needy Government or local body school within the district.
(17) (A) Where, in pursuance of action taken under sub rule (17), an aided post in an institution is rendered surplus, the same shall stand suppressed on transfer of the incumbent to aided institution or Government/Local Body Schools with effect from the date of such transfer.
(17) (B) If the management of the private aided institutions expresses willingness to surrender the Grant-in Aid in the form of surrendering the aided posts staff with assets or without assets, the Competent Authority may absorb the staff to any other needy Government / Local body schools within the District."
