Rc.No.13029/11/2020-EST 3 Dated:08.01.2021 - School Education - Implementation of the Orders issued in W.P.No.22683 of 2020 by Sri.N.Thirupati Rao, filed by Grade-II Headmaster, Z.P.H.S, Bellamkonda, Bellamkonda Mandal Guntur District and 31 others - Orders - Issued. Read:- Orders Dt. 11.12.2020 of the Hon'ble High Court of Andhra Pradesh in w.P.No.22683 of 2020 filed by Sri.N.Thirupati Rao, Grade-II Headmaster, Z.P.H.S, Bellamkonda, Bellamkonda Mandal Guntur District and 31 others.
ORDER:
All the Regional Joint Directors of School Education in the State and all District Educational Officers in the State are informed that Sri.N.Thirupati Rao, Grade-II Headmaster, Z.P.H.S, Bellamkonda, Bellamkonda Mandal Guntur District and 31 others have filed W.P.No.22683 of 2020 before the Hon'ble High Court of A.P. challenging the action of the 15 respondent in issuing the G O Ms No 59 School Education Services 11 Department dated 24 11 2020 with regard to amending/changing the criteria of transfer of Gradell Headmasters In completing 5 years of service instead of completing 5 academic years as on 01 10 2020 as illegal arbitrary unjust improper discriminatory biased contrary to law violation of principles of natural justice and unconstitutional and set aside the same and consequently direct the respondents to effect the transfer counselling to the post of Grade ll Headmaster in accordance with GO Ms No 54 School Education Services II Department dated 12 10 2020.
That vide ref cited above, Hon'ble High court was pleased to grant interim orders as follows:
"In the meanwhile, the respondents shall permit the petitioners to participate in the counselling for the post of Grade.II Headmaster in accordance with the unamended G.O.Ms.No.54 School Education (Ser,II) Dept., dt. 12.10.2020 and without reference to the amendment carried out in G.O.Ms.No.59 School Education (Ser.II) Dept., dt. 24.11.2020 pending further orders.
That after careful examination of the matter and in obedience of the orders of the Hon'ble High Court of Andhra Pradesh, all the Regional Joint Directors of School Education in the State and all District Educational Officers in the State are hereby requested to comply the orders of the Hon'ble High Court of Andhra Pradesh issued in W.P.No.22683 of 2020 food by Sri.N.Thirupati Rao, Grade-II Headmaster, Z.P.H.S, Bellamkonda, Bellamkonda Mandal Guntur District and 31 others subject to the outcome of the writ petition
